World Drummers Partner Program – Terms & Conditions

These Terms & Conditions (“Terms”) govern participation in the World Drummers Partner Program (“Program”).

The Program is operated by  World Drummers, Bulgaria (“World Drummers”, “we”, “us” or “our”).

By applying for, registering for, accessing or participating in the Program, the applicant or Partner (“Partner”, “Affiliate” or “you”) confirms that they have read, understood and agreed to these Terms.

1. Purpose of the Program

The World Drummers Partner Program enables approved Partners to promote eligible World Drummers products and potentially earn commissions from qualifying customer purchases attributed to them.

Approved Partners may receive a unique referral link, promotional coupon and access to an affiliate portal containing referral, sales and commission information.

Participation in the Program does not guarantee any minimum number of referrals, sales, commissions or earnings.

2. Application and Eligibility

All applications are subject to approval by World Drummers.

World Drummers reserves the right to accept or reject an application where reasonably necessary for the operation, integrity or commercial interests of the Program.

Applicants must provide accurate, complete and current information.

World Drummers may request additional information reasonably required to verify the applicant, process payments, comply with accounting or legal obligations, prevent fraud or administer the Program.

Providing false, misleading or materially incomplete information may result in rejection, suspension or termination.

Partners must be legally capable of entering into these Terms under applicable law.

3. Independent Partner Status

Participation in the Program does not create an employment relationship, agency, franchise, joint venture, legal partnership or similar relationship between the Partner and World Drummers.

The Partner acts independently and has no authority to enter into agreements, make representations, provide warranties, incur liabilities or make commitments on behalf of World Drummers.

The Partner may not represent themselves as an employee, agent, official representative, exclusive distributor or authorized dealer of World Drummers unless separately authorized in writing.

4. Standard Commission Rate

Unless World Drummers has specifically assigned or confirmed another rate, the standard Partner commission rate is:

5% of the Eligible Product Value of a Qualified Sale.

The existence of a referral, order or commission entry in the Partner Portal does not by itself create a final or unconditional entitlement to payment.

A commission becomes eligible for payment only when the underlying transaction qualifies as a Qualified Sale under these Terms and has passed any applicable verification.

World Drummers may offer different commission rates, Partner levels, promotional rates, bonuses or other arrangements to individual Partners or groups of Partners.

5. Commission Calculation – Products Only

Commission is calculated solely on the eligible net product value of a Qualified Sale after applicable discounts and adjustments.

The following amounts are excluded from the commission calculation:

shipping and delivery charges;

VAT and other sales or consumption taxes;

customs duties and import charges;

handling or service charges;

and any other non-product charges.

Accordingly, shipping or delivery fees paid by the customer do not generate Partner commission.

6. Customer Partner Discount

Where enabled, an approved Partner may receive a personal referral coupon providing customers with a standard discount of:

3% on eligible products, subject to a minimum eligible order value of €100.

The €100 minimum order value applies to the customer discount only and does not constitute a minimum order value for the Partner to earn commission on an otherwise Qualified Sale.

The customer discount and Partner commission are separate benefits.

The existence of a Partner referral link or coupon does not guarantee that every product, order or promotion is eligible for a discount or commission.

The Partner discount is subject to the minimum order value, product eligibility, promotional restrictions and these Terms.

World Drummers may change the minimum order value applicable to future purchases as part of the Program in accordance with these Terms.

7. No Combination of Discounts and Promotions

Unless expressly permitted by World Drummers, Partner coupons and Partner discounts cannot be combined with other discounts, promotional codes, special prices, promotional benefits or offers.

Products already offered at a reduced or special price may be excluded from the additional 3% Partner customer discount.

This may include, without limitation:

sale products;

special offers;

special deals;

bundles and package deals;

flash sales;

clearance and outlet products;

B-Stock products;

open-box products;

demo products;

returned or refurbished products;

last-unit or special-stock offers;

and other products or promotions already subject to a special or reduced price.

World Drummers may designate particular products, product categories, brands, orders or promotions as:

not eligible for the Partner customer discount;

not eligible for Partner commission;

or eligible for a different or reduced commission rate.

For example, World Drummers may permit commission on the discounted selling price of a sale product while preventing an additional customer Partner discount, or may exclude a heavily discounted or B-Stock product from both the customer discount and Partner commission.

Eligibility applicable to the transaction will be determined by the Program rules and promotional conditions applicable to that transaction.

8. Qualified Sale

A “Qualified Sale” is a legitimate customer transaction that:

has been properly attributed to the Partner through an approved Program tracking method;

contains eligible products;

has been successfully paid;

has not been cancelled, refunded or otherwise reversed to an extent that eliminates the relevant commission;

is not fraudulent, artificial, manipulated or otherwise invalid;

is not a prohibited self-referral;

complies with these Terms;

and has passed any reasonable verification required by World Drummers.

An order appearing in Shopify, GOAFFPRO, the Partner Portal or another system does not necessarily constitute a Qualified Sale until the applicable eligibility requirements have been satisfied.

9. Referral Tracking

The standard referral tracking period is currently:

7 days.

Where applicable, a customer who visits World Drummers through a Partner's valid referral link may be attributed to that Partner for a qualifying purchase made during the applicable tracking period.

Approved Partner coupons may also be used for attribution where supported by the Program.

Tracking can be affected by circumstances outside World Drummers' reasonable control, including browser settings, cookie blocking or deletion, privacy technologies, device changes, ad blockers and third-party technical systems.

World Drummers cannot guarantee that every referral will be successfully tracked.

Where a transaction cannot be reliably attributed to a Partner through the Program's available records, World Drummers is not required to manually or retrospectively attribute the transaction except where required by applicable law.

10. Returns, Refunds, Cancellations and Chargebacks

Commission is not payable on the portion of an order that is cancelled, refunded, returned, charged back, reversed, fraudulent or otherwise determined not to qualify.

Where an order is partially refunded or partially returned, the commission may be recalculated based only on the remaining eligible product value.

If a commission has already been credited or paid and the underlying transaction subsequently becomes wholly or partially ineligible, World Drummers may, to the extent permitted by applicable law:

reverse the corresponding commission;

deduct it from the Partner's current or future commission balance;

or request repayment where appropriate.

11. Verification and Pending Commissions

World Drummers may reasonably verify referrals, transactions and commissions before payment.

A commission may remain pending or payment may be temporarily withheld while World Drummers investigates matters including:

suspected fraud or manipulation;

a pending refund or return;

a chargeback or payment dispute;

unusual referral or coupon activity;

tracking discrepancies;

duplicate attribution;

missing or inaccurate Partner information;

missing payment, tax or accounting documentation;

or another legitimate issue affecting eligibility.

Amounts displayed as pending, estimated, tracked or otherwise unapproved in the Partner Portal should not be treated as finally payable until the applicable transaction has qualified for payment under these Terms.

12. Self-Referrals

Partners may not earn commission on their own purchases.

Partners must not intentionally circumvent this restriction by using alternative accounts, email addresses, identities or other arrangements designed primarily to generate commission on their own purchases.

World Drummers may cancel commissions resulting from prohibited self-referrals and may suspend or terminate the relevant Partner account.

13. Minimum Payout and Payment Schedule

The minimum payout threshold is:

€50 in eligible and approved commissions.

Balances below €50 will normally be carried forward until the minimum payout threshold is reached.

Eligible commissions are generally processed once per month.

Reaching the €50 threshold does not make pending, disputed, returned, fraudulent or otherwise ineligible commissions payable.

Only commissions relating to Qualified Sales and satisfying the applicable payment requirements are eligible for payout.

14. Payment Methods

Available payment methods may include:

SEPA bank transfer and PayPal.

Availability may depend on the Partner's country and other relevant circumstances.

The Partner is responsible for providing complete and accurate payment information.

World Drummers will not be responsible for delays caused by incorrect, incomplete or outdated payment information supplied by the Partner, except to the extent otherwise required by applicable law.

Bank, PayPal, currency-conversion, intermediary or other third-party charges may apply.

15. Taxes, VAT and Documentation

Each Partner is responsible for determining and fulfilling their own tax, VAT, invoicing, registration, reporting and other obligations applicable to commissions received through the Program.

Where reasonably or legally required, World Drummers may request information or documentation including a Tax Identification Number, VAT number, business information, invoice, identification or payment documentation.

Payment may be delayed where information or documentation required to lawfully or correctly process the payment has not been supplied.

Nothing in these Terms constitutes tax, accounting or legal advice to the Partner.

16. Permitted Promotional Activities

Partners may promote World Drummers through legitimate channels such as websites, blogs, social media, videos, livestreams, product demonstrations, educational content, music schools, drum lessons and genuine personal recommendations.

Partners are responsible for complying with applicable advertising, consumer-protection, privacy, platform and disclosure requirements.

Where required, Partners must clearly disclose that they may receive a commission from purchases made through their referral link or coupon.

17. Prohibited Promotional Activities

Partners must not engage in fraudulent, deceptive, misleading, unlawful or abusive promotional practices.

Prohibited conduct includes, without limitation:

spam or unauthorized bulk messaging;

false or misleading product claims;

fake reviews or endorsements;

fraudulent or artificial transactions;

cookie stuffing;

forced clicks;

artificial traffic or attribution manipulation;

misleading redirects;

impersonating World Drummers;

misrepresenting the Partner's relationship with World Drummers;

or deliberately interfering with another Partner's legitimate referrals.

World Drummers may reject commissions generated through prohibited activities.

18. Coupon and Deal Websites

Unless specifically authorized by World Drummers, Partners may not publish, submit or distribute Partner-specific coupons on coupon, voucher, deal or discount-code websites primarily for the purpose of intercepting customers who were already intending to purchase from World Drummers.

Unauthorized coupon distribution, misleading coupon descriptions or attempts to obtain attribution from customers who were not genuinely referred by the Partner may result in cancellation of affected commissions.

19. Paid Advertising and Brand Bidding

Unless expressly authorized in writing by World Drummers, Partners may not bid on, purchase or otherwise target paid search keywords consisting of or confusingly similar to:

World Drummers;

World Drummers trademarks;

World Drummers domain names;

or other protected World Drummers brand terms.

Partners must not create advertisements, websites, domains or social profiles that falsely suggest that they are World Drummers or an official World Drummers advertising channel.

20. Product Claims and Representations to Customers

Partners may describe and recommend World Drummers products using accurate information.

However, a Partner is not authorized to make commitments on behalf of World Drummers concerning matters including:

product availability;

delivery dates;

shipping guarantees;

prices;

discounts;

technical compatibility;

performance guarantees;

warranties;

returns;

refunds;

or other contractual commitments,

except where accurately communicating current information officially provided by World Drummers.

The Partner is responsible for unauthorized representations or promises made independently by the Partner, subject to applicable law.

Customers should be directed to World Drummers' official website and applicable customer terms for current purchasing information.

21. Intellectual Property

World Drummers may provide Partners with logos, banners, product photographs, text, links and other promotional materials.

All applicable intellectual-property rights remain with World Drummers or the respective rights holder.

Partners receive a limited, non-exclusive, non-transferable and revocable permission to use approved materials solely for legitimate promotion of World Drummers while participating in the Program.

Partners may not use World Drummers intellectual property in a misleading, unlawful, defamatory or unauthorized manner.

Upon termination, the Partner must cease unauthorized use of World Drummers branding and Program materials.

22. Partner Levels, Bonuses and Special Rates

World Drummers may introduce Partner levels, performance tiers, bonuses, campaigns and special commission rates.

Eligibility may take into account factors such as sales performance, consistency, quality of promotion, audience engagement and compliance with these Terms.

Unless expressly stated otherwise, progression to a higher Partner level is not automatic.

The standard commission remains 5% unless another rate has been assigned or confirmed for the Partner.

World Drummers may modify future qualification requirements, levels and benefits.

23. Fraud Prevention and Program Integrity

World Drummers may review referral information, traffic patterns, coupon usage, orders and other relevant Program information to protect the integrity of the Program.

Suspicious transactions or commissions may be held for reasonable investigation.

World Drummers may reject or reverse commissions attributable to fraud, manipulation, abuse, prohibited activity, duplicate attribution or other violations of these Terms.

24. Suspension and Termination

Either the Partner or World Drummers may end participation in the Program.

World Drummers may suspend or terminate participation where reasonably justified, including for:

violation of these Terms;

fraud or attempted fraud;

abuse of coupons or referrals;

misleading advertising;

unauthorized use of intellectual property;

conduct harmful to World Drummers, its customers or the integrity of the Program;

or failure to provide information reasonably required to administer the Partner account.

Termination does not convert an otherwise ineligible commission into a payable commission.

Legitimate commissions from Qualified Sales earned before termination will be handled in accordance with these Terms, subject to applicable verification and law.

25. Changes to the Program

World Drummers may modify the Program from time to time.

Changes may include future:

commission rates;

customer discounts;

tracking periods;

minimum payout thresholds;

Partner levels;

product eligibility;

excluded products;

payment procedures;

and promotional rules.

Changes will apply prospectively where required by applicable law.

Material changes may be communicated through the Partner Portal, email, this page or another reasonable method.

Continued participation after an applicable change may constitute acceptance of the updated Terms to the extent permitted by applicable law.

26. No Guarantee of Earnings or Program Availability

World Drummers does not guarantee any minimum amount of traffic, referrals, sales, conversion, commission or income.

Partners participate at their own initiative and commercial risk.

World Drummers does not guarantee uninterrupted or error-free operation of the affiliate platform, referral tracking or third-party services.

Temporary technical failures or third-party interruptions may occur.

27. Third-Party Platforms

The Program may rely on third-party technologies and services, including affiliate tracking, e-commerce, payment and communication platforms.

World Drummers is not responsible for failures, outages, restrictions or errors caused solely by independent third-party systems outside World Drummers' reasonable control, except to the extent liability cannot lawfully be excluded.

28. Customer Rights and Store Purchases

These Partner Program Terms govern the relationship between World Drummers and the Partner.

They do not replace the terms applicable to a customer's purchase from World Drummers and do not limit any mandatory consumer rights that cannot lawfully be excluded.

A customer's purchase remains subject to the applicable World Drummers sales, shipping, return, warranty and other customer terms and applicable law.

29. Limitation of Liability

To the maximum extent permitted by applicable law, World Drummers will not be liable in connection with the Partner Program for indirect, incidental, consequential or special damages, or for loss of anticipated profits, business opportunities, goodwill or data resulting from participation in or inability to use the Program.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Any limitation of liability contained in these Terms will therefore apply only to the extent legally permitted.

30. Partner Responsibility and Indemnification

The Partner is responsible for their own promotional activities and compliance with these Terms and applicable law.

To the maximum extent permitted by applicable law, the Partner agrees to indemnify and hold World Drummers harmless against third-party claims, losses, liabilities, damages and reasonable costs arising directly from the Partner's:

material breach of these Terms;

fraudulent or unlawful conduct;

unauthorized representations made on behalf of World Drummers;

infringement of third-party intellectual-property rights;

or violation of applicable advertising, marketing, privacy or anti-spam requirements.

This provision does not apply to the extent that the relevant claim or loss was caused by World Drummers or where such indemnification is prohibited by applicable law.

31. Privacy and Data Protection

Partner information may be processed as reasonably necessary for purposes including Program administration, referral tracking, fraud prevention, communications, commission calculation, payments and legal or accounting compliance.

Partners are independently responsible for complying with applicable privacy and data-protection requirements concerning personal information they collect or process through their own promotional activities.

32. No Assignment

A Partner may not sell, transfer or assign their Partner account or rights under the Program to another person or entity without prior written approval from World Drummers.

33. No Waiver

Failure by World Drummers to enforce a provision of these Terms in a particular instance does not constitute a permanent waiver of that provision or the right to enforce it in the future.

34. Severability

If any provision of these Terms is determined by a competent authority to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.

The remaining provisions will continue in effect to the extent permitted by applicable law.

35. Entire Agreement

These Terms, together with any specific written Partner terms, commission arrangements or Program rules expressly agreed between World Drummers and the Partner, constitute the agreement governing participation in the Partner Program.

Where a specific written agreement with a Partner expressly conflicts with these general Terms, the specifically agreed provision may prevail for that Partner to the extent stated in that agreement.

36. Governing Law and Disputes

These Terms and participation in the Program are governed by the laws of the Republic of Bulgaria, without prejudice to mandatory legal protections that may apply and cannot lawfully be excluded.

Before commencing formal proceedings, the parties are encouraged to attempt in good faith to resolve any dispute by written communication.

To the extent legally permitted, disputes relating to the Program shall be subject to the competent courts of the Republic of Bulgaria.

Nothing in this provision removes any right or jurisdiction that cannot lawfully be excluded by agreement.

38. Acceptance of Terms

By applying for, registering for or participating in the World Drummers Partner Program, the Partner confirms that they have read, understood and agreed to these Terms & Conditions.

Continued participation in the Program is subject to compliance with these Terms.
